Terms and Conditions

The seller is Goatways, trading through My Budgie’s Journal and budgiejournal.com. Goatways is established at Safraanplein 10, 1314 HK Almere, The Netherlands, and is registered with the Dutch Chamber of Commerce under number 42129713. The VAT identification number is NL005518671B11. Questions may be sent to hello@goatways.online.

These terms apply to every offer, order and agreement for digital products sold by Goatways. By completing an order, the customer confirms that these terms were made available before purchase and accepts them. Any mandatory consumer rights that apply under law remain unaffected.

Goatways sells downloadable digital publications, including printable journals, colouring books, guides and related materials. No physical product will be shipped unless a product page expressly states otherwise.

The product page and checkout describe the main characteristics, included files, format, price and any applicable offer. Images and device mock-ups are illustrative. Colours and page display may vary depending on the customer’s screen, printer, paper and print settings.

The customer is responsible for checking the order and contact details before payment. An agreement is formed when the order is accepted and payment is successfully completed. Goatways will send an electronic order confirmation to the email address supplied by the customer.

Goatways may refuse or cancel an order where there is an obvious pricing or technical error, suspected fraud, misuse of the checkout or another legitimate reason. If payment has already been received for a cancelled order, the relevant amount will be refunded.

Prices shown at checkout include applicable VAT or other taxes unless clearly stated otherwise. The final amount, any discount and available payment methods are displayed before the customer confirms the order.

Payments are processed through Plug&Pay and the connected payment provider, such as Mollie. Goatways does not store complete bank or payment-card details. An order is not due for delivery until payment has been confirmed.

Digital products are normally made available immediately after successful payment through the confirmation page, confirmation email or both. The customer must provide a working email address and should also check the spam or junk folder.

If the download link or file is not received or does not work, the customer should contact hello@goatways.online. Goatways will make reasonable efforts to restore access or provide a replacement file without unnecessary delay.

Customers should download and securely save their purchased files. Lifetime access means that a lawfully downloaded copy may be kept and used for personal purposes without a time limit. It does not guarantee that a particular website, customer portal or external download service will remain available indefinitely.

Consumers normally have a statutory withdrawal period for distance purchases. Special rules apply to digital content that is not supplied on a physical medium.

Where the customer expressly requests delivery before the withdrawal period has expired and acknowledges that the right of withdrawal is lost when downloading begins, the right of withdrawal ends when the customer starts the download. This consent and acknowledgement must be given before purchase and will be confirmed after the order where applicable.

If the required consent or acknowledgement has not been obtained, the customer’s statutory withdrawal rights remain in place. Nothing in these terms limits a right to a remedy where digital content is not delivered, is defective, is materially different from its description or where another mandatory legal right applies.

Subject to these statutory rights, refunds are not provided merely because a customer changes their mind after beginning the download. Approved refunds will normally be made through the original payment method.

Purchase grants the customer a personal, non-exclusive, non-transferable licence to download and use the purchased files for the customer’s own household and birds. Ownership of the intellectual property does not transfer to the customer.

The customer may:

• save the files on personal devices;
• print copies for personal use within the customer’s own household;
• complete, annotate and reuse tracking pages for the customer’s own birds; and
• provide a completed Sitter Guide to a person currently caring for the customer’s bird.

The customer may not:

• sell, sublicense, redistribute or give away the original digital files;
• upload the files to public websites, shared drives, groups, marketplaces or social-media libraries;
• remove copyright notices or present the materials as their own work;
• use the files as templates for competing products; or
• use the materials commercially without prior written permission from Goatways.

The products provide general educational and organisational information about observing and recording a budgie’s usual behaviour and health. They are not veterinary advice, a diagnosis, a medical device or a substitute for professional examination and treatment.

The customer remains responsible for decisions concerning an animal’s care. If a bird appears unwell, is injured, has breathing difficulty, stops eating or drinking, or shows another concerning change, the customer should contact an appropriately qualified veterinarian promptly. Use of a journal or checklist should never delay veterinary care.

Because every bird and medical situation is different, Goatways does not guarantee that use of a product will detect illness, prevent harm, reduce veterinary costs or produce a particular health outcome.

Goatways will provide digital content that materially conforms to its description and will take reasonable steps to correct a defective or inaccessible file. The customer is responsible for having suitable software and equipment to open, view or print the stated file format.

Where Goatways releases corrections or content updates to a purchased product while that product remains supported, those updates will be made available to existing customers without an additional product fee where reasonably practicable. This does not require Goatways to create new editions, add new products or support obsolete software indefinitely.

All copyright, trademarks, designs, text, illustrations, layouts and other intellectual-property rights in the products and website belong to Goatways or its licensors. Any use beyond the personal-use licence in section 8 requires prior written permission.

Discounts and launch offers apply only during the stated period or while displayed at checkout. Unless stated otherwise, promotions cannot be exchanged for cash, applied retrospectively or combined with other discounts. An obvious pricing error does not require Goatways to supply a product at the incorrect price.

Goatways is responsible for losses that are a reasonably foreseeable result of failing to comply with the agreement, subject to applicable law. Goatways is not responsible for indirect or unforeseeable losses, loss caused by incorrect use of the materials, printing variations, incompatible customer equipment or a customer’s decision to delay or avoid professional veterinary care.

Nothing in these terms excludes or limits liability where exclusion is prohibited by law, including mandatory consumer rights or liability for wilful misconduct or gross negligence.

Goatways is not responsible for delay caused by events outside its reasonable control, such as widespread internet outages, payment-provider disruption or other external technical failures. Where possible, Goatways will take reasonable steps to reduce the impact and complete delivery as soon as practicable.

Questions or complaints should be sent to hello@goatways.online and should include the customer’s name, order number and a clear description of the issue. Goatways will acknowledge and respond to a complaint within a reasonable period and aims to provide a substantive response within 14 calendar days.

Personal data is processed in accordance with the Privacy Policy published at budgiejournal.com/privacy. Payment and order data may also be processed by Plug&Pay, Mollie and other service providers involved in completing the transaction.

Goatways may update these terms to reflect changes to products, business operations or applicable law. The version accepted at the time of purchase continues to govern that order. The latest version and effective date will be published online.

These terms and the agreement are governed by Dutch law. If the customer is a consumer living in another country, this choice does not remove any mandatory protection provided by the law of the customer’s country of residence.

The parties will first try to resolve any dispute directly. If no solution is reached, a dispute may be submitted to a court with jurisdiction under applicable law.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. The invalid provision will be replaced, where possible, by a lawful provision that most closely reflects its intended purpose.
